Autoverse Pty Ltd ACN 659 516 186 and its affiliates (Company) provide services to connect car users and car care professional services providers (Services) via the mobile application AutoPort (App) and/or its website (Website).
The purpose of this Legal Disclaimer & Privacy Policy is to govern your access to and use of the Services and the App/Website as well as to inform you about how we process information about you. By using the Services and the App/Website, you are agreeing to the terms of this Legal Disclaimer & Privacy Policy, as may be updated by us from time to time.
You acknowledge and agree that the Company disclaims all and any guarantees, undertakings and warranties, expressed or implied, in the provision of the Services and is not liable for any loss or damage whatsoever (including personal injury or property damage, negligence or otherwise, incidental or consequential loss or damage) arising out of, or in connection with the Services, to the fullest extent permitted by law. Where the Company cannot exclude such liability under the Competition and Consumer Act 2010 (Cth), its liability to you will be limited to: 1) if the breach relates to services, the supply of those services or the payment of the cost of those services supplied again; or 2) if the breach relates to goods, the replacement or repair the goods.
You hereby release, discharge and hold harmless the Company from all actions, proceedings, claims, liabilities, demands, damages and expenses and howsoever occurring, brought against or made upon the Company by you or by any other person, arising directly, indirectly or in any other way connected with the provision of the Services, whether in contract, tort (including negligence), breach of statutory duty or otherwise, irrespective of any negligence on the part of the Company. For the avoidance of doubt, this extends to any directors, officers, employees, contractors, agents, representatives, licensees or permitted assigns of the Company. You agree and acknowledge that the total cumulative liabilities of the Company in aggregate for all claims is limited to any service fee paid by you to the Company.
The kind of information that we collect from you will depend on how you use the App/Website. The information which may be collected may include but not limited to:
Name and contact details;
Payment details;
Vehicle details including but not limited to vehicle registration details and insurance;
Location;
Transactional data;
Communications from you including inputs, feedback, survey responses, testimonials or complaints; and
Any other information of any kind in any form provided by you.
We may collect personal information from you whenever you input such information into the App/Website.
We may also collect cookies from your mobile devices which enable us to tell when you use the App/Website and also to help customise your App/Website experience. As a general rule, however, it is not possible to identify you personally from our use of cookies.
The purpose for which we collect information is to provide you with:
the Services,;
the best service experience possible on the App/Website; and
any other services which are reasonably necessary for or associated with the provision of the Services.
We may produce macro statistics based on the information about the users of the App/Website which is collected and processed via the App/Website and may disclose to a third party such macro statistics which do not reveal any of your personal information.
By providing your survey responses, testimonials, feedback or complaints, you grant to us a royalty-free, worldwide, irrevocable, perpetual license to use and incorporate into the App/Website any general suggestions, enhancement requests, testimonials, recommendations or other feedback provided by you.
